Federal registration can only be obtained by trademark owners who actually utilize their trademark in commerce. Trademark owners are thus required by the USPTO to provide evidence of continued use of their marks at regular intervals following registration.

When you initially registered your trademark, you were asked to provide a sample that showed how the trademark will be used. You need to provide fresh evidence that you are currently selling goods or services with the trademark in order to renew it.

You will have to renew your trademark registration continuously throughout the trademark’s lifespan:

  • Between the fifth and sixth year anniversary: File a Declaration of Use and/or Excusable Nonuse under Section 8 of the Trademark Act.
  • Between the ninth and tenth year anniversary: File a Combined Declaration of Use and/or Excusable Nonuse/Application for Renewal under Sections 8 & 9 of the Trademark Act.
  • Every ten years afterward: File the Combined Declaration of Use and/or Excusable Nonuse/Application for Renewal under Sections 8 & 9 of the Trademark Act.

The USPTO will still accept a renewal application within the six-month grace period if the renewal deadline is missed. Nevertheless, the USPTO requires an extra $200 late filing fee for each class.

The USPTO will terminate your registration and your trademark will expire if the six-month grace period is not met. Reapplying for trademark registration is necessary if you wish to maintain your current trademark status.

When you first filed your trademark, it might have been for more than one class of products or services. However, you may have since decided to stop using the trademark for one of those classes. You have the option to specify which classes your trademark is currently being used in when you renew it.

Renewal applications cannot be used to include additional classes of products or services in your trademark.

You must provide your trademark’s registration number and a specimen showing that your trademark is currently in use. You must also provide your contact information if it has changed.

Your trademark renewal fees depend on the form you’re submitting:

  • Section 8 Declaration (5-6 Years): $300 per class
  • Section 15 Declaration of Incontestability (5-6 Years): $250 per class
  • Combined Section 8 & 15 Declaration (5-6 Years): $550 per class
  • Section 9 Declaration (9-10 Years): $350 per class
  • Combined Section 8 & 9 Declaration (9-10 Years): $650 per class

The United States Patent and Trademark Office will treat your trademark as abandoned if you do not renew it before its registration expires. If you allow the trademark to expire, it will no longer be protected legally and another company can register it.

A six-month extension is available from the USPTO in the event that you fail to renew your trademark by the due date. But if you miss the deadline to renew, your trademark will be lost forever. If you want to get your trademark registered, you'll have to start the application process all over again.
